"Platform" – a group of affiliated websites made available on the Internet from the address: www.gamivo.com. Capitalized words not defined in this Article have the meaning given to them in the Terms & Conditions.
These Regulations set out the terms and conditions for the provision of the GAMIVO SMART service by GAMIVO.COM as part of the Platform.
This contract for the provision of the Service is concluded for an indefinite period, and the Service is continuous, with the proviso that the Buyer may conclude only one contract for the provision of the Service at a given time, per Account. Payment of the Service takes place during Billing Periods.
The Service allows Buyers to use the following Benefits as specified in the Regulations:
possibility of contacting the Platform's customer service department via the LIVECHAT program,
the service of the Customer Protection Program, regulated in the Terms & Conditions, for all Buyer's orders without additional charges,
access to dedicated offers made available exclusively to Buyers (Further: Promotional Offers). Promotional Offers may include special offers and giveaways and are covered by the GAMIVO SMART program. Promotional Offers are marked with a special icon that facilitates their search,
priority shipping of orders placed under the pre-order option.
access to the subscription-only coupon that gives special discounts. Said coupon can be used 3 times a month. Coupon's uses are automatically refreshed after each charge from the SMART subscription.
The Service or Benefits may not be used for resale or free sharing on the Platform to other Users, which means that the Service may be provided only to and for the individual use of the Buyer.
The Service may only be used on the Platform.
GAMIVO.COM may by means of electronic notifications, to the e-mail address provided by the Buyer in the Account settings, direct information containing the date of the end of the Billing Period.
Scope of Services GAMIVO SMART
The Buyer, regardless of the Billing Period selected by them, is entitled to an unlimited possibility of using the Benefits.
The Buyer is not entitled to a financial compensation for the Benefits they did not use.
Activation of the Service
Payment for the GAMIVO SMART Service may be made by means of payments made through a payment service, using the payment methods currently provided by the Platform. As a Gamivo SMART member, you are automatically charged once a month on the date you signed up. Your Gamivo SMART subscription is charged at the beginning of your billing cycle and can take several days to appear on your account. If your billing date is scheduled for a day that does not occur in every month (for example, the 31st), you will be billed on the last day of that month instead.
The Service is activated when the User makes the payment for using the Service using the payment service (payment status "Completed").
The price of the Service purchased is 1.49 Euro+ Service fee and taxes for the first month. After the first month the price is 2.49 Euro + Service fee and taxes, as a payment in 1 month Billing Period. The Buyer may choose the length of the Billing Period.
In order to activate the Service, the User should complete the appropriate form available on the Platform, including the payment option of his choice, referred to in paragraph 3 above, and then accept the Regulations and confirm his choice. Immediately after confirmation, the User will be transferred to the payment operator's website.
As soon as the payment status is confirmed as "Completed", a message confirming the conclusion of the contract between the Buyer and GAMIVO.COM will be sent to the Buyer's indicated email address, the subject of which is the GAMIVO SMART provided by GAMIVO.COM under the conditions set out in the Regulations and a message containing other information required by law.
Invoices for the GAMIVO SMART service are issued to the data provided in the Buyer’s account settings. By accepting the Regulations, the Buyer agrees to receive electronic invoices and corrective invoices issued by GAMIVO.COM. You can find your invoices in your customer panel.
Service for Buyers in connection with the GAMIVO SMART Service
The conclusion of the contract by the Buyer of GAMIVO SMART Services entitles him to use the Promotional Offers if they are available in the current GAMIVO SMART offers.
The condition for the use of specific Promotional Offers by Buyers may be the prior acceptance of the relevant regulations regarding the service or program to which the Promotional Offer relates.
GAMIVO.COM may, at its own discretion, offer various Promotional Offers for the period of its choice, as well as organize other promotional activities regarding GAMIVO SMART, therefore it is entitled in particular to total or periodic reduction of fees for the Service provided, expanding the catalog of Offers Promotional, as well as later activation of additional prizes awarded as part of the bonus sale at the time of sale of the GAMIVO SMART Service, on the conditions provided separately for such actions.
Benefits under the User Protection Program with a guarantee of consideration of questions and notifications is carried out according to the provisions of the Terms & Conditions.
Benefit of contacting the Platform’s customer service department via the LIVECHAT program is possible without hourly limitations, 7 days a week.
Termination of the Contract
The contract with GAMIVO.COM regarding the provision of the Service may be terminated by the Buyer, by submitting a resignation to GAMIVO.COM, provided that the recommended way to terminate the contract is to use the “Resignation” option available at the Buyer’s account. After the resignation, the Service will be active until the expiry of a given Billing Period.
The Buyer may terminate the contract for the provision of the GAMIVO SMART Service at any time, as described in paragraph 1 above, in case of gross violation by GAMIVO.COM of the provisions of the Regulations.
The contract with GAMIVO.COM regarding the provision of the Service may be terminated by GAMIVO.COM by submitting a statement electronically to the Buyer's e-mail address provided in the settings of his Account (hereinafter the "Statement"), if after the expiry of a given Billing Period , The Buyer will not make another payment for the Service within 14 days from the date of the previous Billing Period.
In the event that the Buyer's actions violate the provisions of the Regulations, Terms & Conditions or if the Buyer has taken any actions that negatively affect the security of the Platform 's operation, harm other Users or are contrary to the assumptions of the GAMIVO SMART Service described in the Regulations, or aimed at bypassing the safeguards used by GAMIVO.COM or consisting of falsifying data as part of the Service, GAMIVO.COM has the right to suspend the provision of the Service to the Buyer.
In the event of a paid Service, the charges on the card or Paypal account will be automatically carried out by GAMIVO.COM until the Buyer withdraws the consent.
GAMIVO.COM reserves the right to amend these Regulations due to the change in economic and market conditions, which will enter into force on the 15th day from the day of informing the Buyers about the change in the manner specified in Paragraph 1 above, with the proviso that changes in the price for the Service shall apply to subsequent Billing Periods following the Billing Period during which the change will be made.
The Buyer will be additionally notified of changes to the Regulations by e-mail. The Buyer may refuse to accept them by resignation. Failure to submit the resignation referred to in the previous sentence is considered as their acceptance by the Buyer. Refusal to accept changes is tantamount to termination of the contract for the provision of the Service between the Buyer and GAMIVO.COM. During the notice period, the Buyer shall be bound by the wording of the Regulations before the change.
GAMIVO.COM reserves the right to temporarily modify the rules set out in these Regulations for promotional campaigns organized by GAMIVO.COM or its business partners. The rules for promotional campaigns will be each time indicated in the individual regulations of the promotional campaigns in question.
For all matters not covered by these Regulations, the provisions of the Terms & Conditions and generally applicable Malta law will apply.
In the event of a conflict between these Regulations and the Terms & Conditions, the provisions of these Regulations shall apply.
If any provision of the Regulations proves to be invalid or ineffective, it will not affect the validity of the remaining provisions. Invalid or ineffective provision will be replaced by such valid provision which reflects the economic value, the intention of the parties and objective of the invalid or ineffective provisions to the highest extent. The pertinent clause does not apply to the Users who act as consumers.
